Terms of Service
The terms under which brokerages, MLSs, agents, and API consumers use the Broker Union platform. They sit alongside any individually-negotiated agreement and any product-specific policy (Data Cooperation, Privacy).

1. Who we are
Broker Union is a federated platform for real-estate listings, transactions, and analytics, operated by Listing Data LLC (“Listing Data,” “we,” “us”). These Terms govern access to and use of brokerunion.com and the network surfaces operated under it — including tenant subdomains, the public API, the admin consoles, and any documentation or developer tools we publish.
2. Acceptance
By accessing the platform, creating an account, signing a tenant agreement, requesting an API key, or otherwise using any part of the service, you agree to these Terms. If you are accepting on behalf of an organization, you represent that you have authority to bind that organization.
3. The platform is infrastructure
Broker Union is a software platform. We are not a real-estate brokerage, an MLS, a lender, a title company, or a party to any real-estate transaction conducted on the platform. Brokerages and MLSs that operate as tenants on the platform are responsible for their own licensing, regulatory compliance, escrow, recordkeeping, and fiduciary obligations.
Nothing on brokerunion.com creates an agency, brokerage, or fiduciary relationship between Listing Data and any visitor, tenant, agent, or consumer of the API.
4. Account types
4.1 Tenant accounts (brokerages, MLSs)
Tenants operate their own walled environment on the platform. The tenant’s principal broker, designated officer, or other authorized administrator is responsible for the data the tenant publishes, the agents and members it provisions, and the actions taken under its tenant.
4.2 User accounts (agents, staff, members)
Users access the platform through a tenant. Tenant administrators can suspend or remove user accounts at any time. Users may not share credentials.
4.3 API consumer accounts
API consumers (data brokers, search portals, derived-product builders) access the platform under an API key issued under contract. API use is also subject to the Data Cooperation policy.
5. Acceptable use
- You will not use the platform for unlawful purposes or to violate the rights of any other person or organization.
- You will not attempt to access tenant environments other than your own, circumvent rate limits, scrape pages, or harvest credentials.
- You will not introduce malicious code, attempt to interfere with the integrity of the network, or probe systems beyond the scope of a documented bug-bounty program.
- You will not use the platform to send spam or unsolicited messages (SMS, email, voice) — outbound communications are subject to the consent and opt-out controls in the relevant tenant’s configuration and applicable law.
- You will not use Broker Union output to train machine-learning models outside the scope of your individually-negotiated agreement.
6. Content ownership
Tenants and producers retain ownership of the data and content they publish into the platform. By publishing, they grant Listing Data the non-exclusive license needed to host the content, route it to the audiences they authorize, and operate the platform. Listing Data retains ownership of the software, schemas, and aggregate analytics produced from the operation of the network.
7. Fees
Pricing for tenant subscriptions and API consumption is set in the applicable individually-negotiated agreement. Where no agreement is in place, default rate cards published in the admin console apply. Sandbox / evaluation access is free, rate-limited, and excludes any contractually restricted fields.
8. Suspension and termination
We may suspend or terminate access — temporarily or permanently — for material breach of these Terms, for non-payment of fees, for risk to other tenants or to the integrity of the network, or as required by law. You may terminate your account at any time; producer-side data export is available on request under the Data Cooperation policy.
9. Disclaimers
The platform is provided “as is.” We do not warrant that the service will be uninterrupted, error-free, or that any specific data will be available at a given time. Tenants are responsible for verifying the accuracy of data they rely on for consumer-facing decisions (price, status, dates, etc.).
10. Limitation of liability
To the maximum extent permitted by law, Listing Data’s aggregate liability for any claim arising out of these Terms is limited to the fees paid by the claimant to Listing Data in the twelve (12) months preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages.
11. Indemnification
Tenants and consumers will defend, indemnify, and hold Listing Data harmless from any claim arising out of (a) data they publish or pull, (b) their use of the platform in breach of these Terms or applicable law, and (c) any transaction they conduct outside the platform that arose from contact made on the platform.
12. Governing law
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-laws principles. Disputes will be resolved in the state and federal courts located in Delaware, unless the parties agree in writing to arbitration.
13. Changes
We may update these Terms as the platform evolves. Material changes will be announced in the admin console at least thirty (30) days before they take effect. Continued use after the effective date constitutes acceptance.
